Electricity market transformation – key changes in the ERAA
On 1 January 2025, the Electricity Regulation Amendment Act 38 of 2024 (ERAA) came into effect. This followed extensive stakeholder engagement and multiple draft iterations. The ERAA aims to bring change to South Africa's electricity sector. It continues the shift from Eskom's vertically integrated monopoly to the Transmission System Operator SOC Limited (TSO).
Unmanaged energy consumption is now a real threat to businesses
Last year, South African businesses were spared from Eskom’s proposed 32% tariff hike, which would have come into effect from 1 April 2023, with energy regulator National Energy Regulator (NERSA) postponing its decision on this for the next two financial years.

Stats SA’s April Statistics of Liquidations and Insolvencies paint a very grim picture. The number of business liquidations increased by 53.1% between April 2018 and April 2019. The number of insolvencies increased by 30.1% between March 2018 and March 2019.
Power grid set to surge
Minister of Energy, Jeff Radebe, purportedly granted a welcome deviation from South Africa’s existing power generation licensing regulations that should see a relaxation of the process, encouraging additional power supply into the local grid. The change comes amidst growing concern over an already-strained national power supply and its ability to tolerate the increased winter load.
