The Employment Equity Amendment Act 2025 marks a major step in South Africa’s effort to speed up workplace transformation. It also addresses persistent inequalities.

A key change is the redefinition of a designated employer. The previous definition depended on both staff numbers and turnover. The new definition applies only to organisations with 50 or more employees. This change reduces the burden on small businesses.

To qualify, employers must meet sectoral targets and submit annual reports. They must also avoid any recent findings of unfair discrimination or minimum wage violations.

Importantly, sectoral targets are not quotas. They are flexible five-year benchmarks, ending on 31 August 2030. The Act allows for justifiable non-achievement, such as when skills shortages or economic downturns occur. The aim is sustainable transformation rather than rigid numerical enforcement.

  • Keep detailed HR records, including recruitment, training, development and barriers to equity.
  • Implement fair hiring and promotion practices.
  • Consult regularly with workplace committees.
