In National Union of Metalworkers of South Africa obo Nyawuza / PFG Building Glass [2024] 6 BALR 595 (NBCCI), the National Bargaining Council for the Chemical Industry (NBCCI) considered an unfair dismissal dispute. The dispute concerned an employee who was dismissed for misconduct after testing positive for cannabis in his system.

There have been numerous complaints in recent years from both landlords and neighbours that tenants are smoking cannabis in their rental property. When neighbours start to complain, landlords are often caught in the middle. Is there really anything they can do to resolve the situation?

President Cyril Ramaphosa’s State of the Nation Address (SONA) on 10 February 2022 highlighted some key issues requiring attention. Most notable were his commitment to cut red tape constraining business, to boost infrastructure investment and to continue with reform.

The pharmaceuticals group says its management agreement with Ukusekela is already bearing fruit. Nutritional Holdings says its plan to sign an interim management agreement to manage cannabis company Ukusekela Holdings has already borne fruit, with a return to profitability for the first time in several years.

With deregulation glinting globally, the cannabis market is expected to explode. New Frontier Data’s Global Cannabis Report: 2019 Industry Outlook estimates that there are around 263 million legal users of cannabis and cannabis-related products worldwide. Africa is home to 83 million of these. The report estimates that the total legal cannabis market hit a value of $344 billion in 2018, and ranks Africa as one of the top five regional markets, accounting for $37.3 billion.

Following the recent landmark decision of the South African Constitutional Court, in which the private and personal use of cannabis was decriminalised, together with the publication of guidelines regarding the cultivation of cannabis for medical, scientific and clinical research purposes, an enhanced interest in the cannabis industry has emerged and investors are keen to be amongst the first to capitalise on the potential growth of this 'green' market.

Brand owners take note. The movement to legalise the possession and consumption of cannabis is real. With the growing global trend to recognise cannabis as legal it can only be a matter of time until various other cannabis products will be legalised too.
