On 23 November 2018, the Labour Laws Amendment Bill was signed into law. The Bill provides a minimum period of leave entitlement to employees who are fathers, adoptive parents and parents in a surrogate motherhood agreement, amending the Basic Conditions of Employment Act (BCEA) and the Unemployment Insurance Act (UIF).

Parliament’s Select Committee on Economic and Business Development has passed a series of Labour Bills: National Minimum Wage Bill (B31-2017), Basic Conditions of Employment Amendment Bill (B30-2017), Labour Relations Amendment Bill (B32-2017), Labour Laws Amendment Bill (B29-2017). Parental leave – a minimum term of employment?

Currently, South African employment laws provide minimum leave entitlements for all employees for annual leave, sick leave, family responsibility leave, and unpaid maternity leave for female employees. A proposed amendment will introduce, for the first time, a new leave type of Parental Leave.
