We welcome the signing of the Minimum Wage Bill into law by President Cyril Ramaphosa. Our firm was appointed by Nedlac to draft the Minimum Wage Bill as well as the amendments to the Labour Relations Act, which also came into effect today.
Why workers are prepared to strike until their demands are met
A major takeout from the month-long bus strike earlier this year is that workers were prepared to strike for a protracted period until their main demands were met, including that they be paid for the month that they did not work as a result of the protest action.
Strikes and the Law
Strike action is an area of labour law where the stakes are high. The Labour Relations Amendment Bill, 2017 published on 17 November 2017, attributes a misalignment between the law on strikes and action taken by parties during industrial action, as the root cause for protracted and often violent industrial action.
